Ouch: Botched Circumcision

A 5-year-old boy won a $1.3 million jury award to compensate him for damage to his penis when he was circumcised at 12-hours old.

The morning after Dr. Marc Feldstein delivered Daniel Burden  at Northwestern’s Prentice Women’s Hospital in Chicago on Oct. 4, 2007, he performed a routine circumcision on the newborn. During the procedure, Feldstein amputated the tip of the baby’s penis. He was rushed to a nearby hospital where doctors reattached it.

The boy’s penis is expected to be fully functional but it will have some scarring and he has a risk of altered nerve sensation.

The doctor and hospital claimed that partial amputation was a known complication that could happen during the procedure.

“The truth is, it is the oldest surgical procedure known to man and the most common one performed on baby boys in America. If this was truly a known risk, then nobody would dare have a circumcision,” Kotin said.But the parents’ attorney, Daniel M. Kotin, argued the defendants were negligent.

Another attorney for the boy, Timothy Tomasik, said the boy “will be grateful that his injury was not as devastating as it could have been. But he will always be different, and that is something he has to live with for the rest of his life.”
